Construction contracts law and management is possibly the most complex part of an industry that deals with creating large buildings, installing electrical wiring and water lines. Without capable individuals overseeing construction contracts law and management, a construction company or architect can end up in serious trouble and losing a great deal of money.
Construction contracts law and management can be handled by an attorney on staff with a construction company or architect, or they may decide to retain outside counsel. They are tasked with developing legal, binding contracts, making sure they are followed by all sides and, if necessary, filing suit for breach of those contracts. A construction management contract is an agreement by the contractor and the property owner (or their representative) that binds the contractor to performing a specific job, for which they are paid a set amount.
That is the easy part of construction contracts law and management. The legal counsel must ensure that the people signing for both parties are legally and mentally able to do so and that both sides are financially capable of holding up their end of the contract. The contracts must be worded so that the expectations of both sides are fully laid out and do not violate any laws. Any uncertainty and the contract may not hold up in court. The proposal must be formally made and its acceptance absolute by the other party (as in, documents must be signed).
Construction contracts law and management can get ugly if one of the two sides does not live up to its part of the contract. In this case, there is a breach of contract and can lead to a lawsuit. While there are legitimate reasons for a contract to be breached (especially on the side of the contractor), they are few and far between. If a breach of contract suit is filed and the plaintiff is successful, they may receive compensation for their losses or any damage done to their reputation. It is up to the counsel for the contractor to defend the company when they are saddled with a lawsuit and to pursue clients who fail to pay once a contract is successfully completed.
